Hospital Leave [Rule 103]

Eligibility for Hospital Leave

The following categories of employees are eligible for hospital leave under Rule 103:

  1. Police Officers: Officers not above the rank of Head Constable.

  2. Fire Service Personnel: Personnel at or below the rank of Leading Fireman, including Drivers, Mechanics, and Fireman Drivers.

  3. Forest Subordinates: Excluding clerks, those with pay not exceeding Rs. 39,300 (effective from 01/07/2019).

  4. Jail Staff: Head warders, warders (male or female), and Matrons of the Jails Department.

  5. Government Laboratory Subordinates: Employees working in government laboratories.

  6. Machinery Operators: Subordinates in other departments engaged in operating government machinery.

  7. Last Grade Employees: Employees in the lowest grade across all departments.

  8. Excise Department Staff: Guards and Preventive Officers.

  9. Home Guard Volunteers: Government servants serving as Home Guard Volunteers.

Conditions for Granting Hospital Leave

  1. Medical Certificate: Employees must provide a medical certificate from their authorized medical attendant stating that the leave is necessary for recovery.

  2. Head of Office Certificate: A certificate from the head of the office confirming that the illness or injury was directly caused by risks incurred during official duties.

  3. Applicability to Temporary Employees: Hospital leave is also admissible to temporary employees [Note 2 to Rule 103].

  4. Duration: The leave may be granted for as long as the sanctioning authority deems necessary [Rule 104].

Leave Salary

The salary during hospital leave is structured as follows:

  1. For the first 120 days: Equal to the salary provided during earned leave.

  2. For the remaining period: Equal to the salary provided during half-pay leave.

Additional Provisions

  1. Non-Debitable: Hospital leave is not debited against the employee’s regular leave account and can be combined with other admissible leaves.

  2. Record Keeping: All Heads of Departments must maintain a register of special leaves (e.g., hospital leave, maternity leave, etc.) to facilitate audits and ensure compliance with leave conditions.
