Pay Fixation Rules

Fixation of Pay under Rule 28

Applicability: Applies to promotion from a substantive post to a higher substantive post with a pay scale minimum exceeding Rs.95,600/- (w.e.f. 01/07/2019).

Pay Fixation: Pay is fixed in the higher substantive scale at the next stage above the pay enjoyed in the lower post on the date of promotion.

Refixation: Not allowed.

Increment: Next increment granted after one year from the date of promotion.

Fixation of Pay under Rule 28A
-
Applicability: Applies to promotion from a substantive, temporary, or officiating post to a substantive, temporary, or officiating post/higher grade post with a pay scale minimum not exceeding Rs.95,600/- (w.e.f. 01/07/2019).

Pay Fixation: Pay is initially fixed on the date of promotion at the stage next above the pay notionally arrived at in the lower time scale by increasing the actual pay drawn by one increment.

Refixation: Allowed whenever there is a change in pay in the lower time scale. Next increment granted after one year from refixation.

Restrictions:

Refixation not allowed for promotions in substantive posts.

Refixation not allowed if more than two increment benefits are enjoyed on initial fixation. In such cases, the next increment is granted after one year.

Time-Bound Higher Grade:

Pay fixed on the date of eligibility at the stage next above the pay notionally arrived at in the lower time scale by increasing the actual pay by one increment.

Next increment granted on the normal increment date of the lower post, or after one year if more than two increment benefits are enjoyed on initial fixation.

Option facility for time-bound higher grade discontinued w.e.f. 01/02/2016.

Officiating Officer: An officer officiating in a post, when appointed to a higher post on the advice of the Public Service Commission or otherwise, is eligible for initial pay fixation under this rule and entitled to refixation benefits [Rule 28A G.D.1(2)].

Fixation of Pay under Rule 30

Applicability: Applies to a holder of a post whose pay scale has changed.

Pay Fixation:

Pay fixed at the same stage in the new scale.

If the previous pay is not a stage in the new scale, pay is fixed at the next lower stage, with the difference treated as personal pay to be absorbed in future pay increases.

If the previous pay is less than the minimum of the revised scale, pay is fixed at the minimum.

Increment: Next increment granted on the normal increment date of the old scale.

Applicability: Applies to promotion or higher grade post with a pay scale minimum exceeding Rs.95,600/- (w.e.f. 01/07/2019).
